Can a Hiring Attorney bill their client for the amount charged by the Contract Attorney and also add a surcharge?

There are several opinions that indicate a Hiring Attorney may bill their client for the amount charged by the Contract Attorney and also add a surcharge to the amount charged by the Contract Attorney. See, e.g., ABA Comm. on Ethics and Prof’l Responsibility Formal Op. 00-420 (Nov. 29, 2000) (finding that a lawyer may add a surcharge on amounts paid to a contract attorney when services provided by the contract attorney are billed as legal services); ABA Comm. on Ethics and Prof’l Responsibility Formal Op. 08-451 (Aug. 5, 2008) (discussing attorney’s obligations when outsourcing legal or nonlegal support services).



How does a Hiring Attorney and Contract Attorney clear conflicts, and can I post jobs anonymously or privately?

When a Hiring Attorney posts a job on HeroCounsel, they should refrain from including any confidential or privileged information in the job posting. Once the job is posted, the Hiring Attorney and Contract Attorneys will be able to privately message each other or conduct a video call to perform a conflict check before proceeding any further with the job (you can also share documents). Additionally, the Hiring Attorney can post jobs anonymously to prevent Contract Attorneys from seeing the Hiring Attorney’s name or law firm, or the Hiring Attorney can post a job privately so no Contract Attorney will see the job unless the Hiring Attorney invites them first.



Does HeroCounsel have any platform fees?

HeroCounsel charges a platform fee of 20% to the Contract Attorney on all jobs and tasks. Additionally, both the Hiring Attorney and Contract Attorney will be charged for payment processing fees charged by Stripe (such fees are nominal). HeroCounsel does not have any subscription/membership fees, and there are no fees charged for posting jobs or applying for jobs. It is free to sign up on HeroCounsel as a Contract Attorney or a Hiring Attorney.



How do payments work?

All payments on the HeroCounsel Platform are processed by our payment provider, Stripe. For Contract Attorneys, you should be prompted by the HeroCounsel Platform to create an account with Stripe. Otherwise, please visit your Settings page on HeroCounsel and select Stripe Registration in order to complete your registration. For Hiring Attorneys, you should be prompted by the HeroCounsel Platform to enter your credit card information. Otherwise, please visit your Settings page on HeroCounsel and select Payment Methods in order to add your payment information.



Are Contract Attorneys covered by the Hiring Attorney’s malpractice insurance policy?

Most legal malpractice insurance policies provide coverage for contract attorneys. This will typically fall under the section of the policy that defines the insured and will typically refer to a “contract attorney”. Please carefully review and analyze your own policy.

Do I need to go into an office?

The vast majority of the jobs posted on HeroCounsel are remote. Occasionally, a Hiring Attorney may post an in-person job or a hybrid job. Regardless, the Contract Attorney picks and chooses which jobs they want to accept. The Contract Attorney can work whenever they want, and wherever they want, just as long as the Hiring Attorney’s jobs are timely and satisfactorily completed.

How do I become a Contract Attorney on HeroCounsel?

Please start by registering and creating a Contract Attorney account with HeroCounsel and fill out the pertinent account information. We will then review your account and information, and let you know if we would like to schedule an interview. We interview Contract Attorneys before they are allowed to join. It is how we ensure top quality, and we also want to make sure HeroCounsel is the right fit for the Contract Attorney. After the interview, we will let you know if you have been approved.
